Your company is likely exporting technology and software more frequently and in more ways than ever before. The more you export, the more important it is to make sure you have the accurate classification in the Commerce Control List (CCL). If you get the wrong Export Control Classification Number (ECCN) for the items you export, you could easily have hundreds of people in your organization unknowingly, and repeatedly, making illegal exports.
While classifying hardware and materials is difficult, classifying technology and software is often more challenging. Sometimes, the classification of your technology depends on the item to which it is related, and, unfortunately, sometimes, it does not. There are times when equipment is EAR99 and the technology for that equipment could require an export license for most countries.
We will highlight and explain the key areas of the CCL and the Export Administration Regulations (EAR) that play a decisive role in determining the ECCN for your technology and software. The EAR and CCL have changed in major ways over the past several years. Export Control Reform (ECR) did not simplify classification rules. In fact, ECR made the rules more complex and made the CCL much longer than before. When was the last time you took a fresh look at these changes?
After you’ve determined that you have something that is subject to the EAR and you’ve classified it, it’s time to find out if it’s eligible for No License Required (NLR). The question, “Is this export eligible for NLR?” is an important one that can change how you move forward with a transaction within your business. The answer lies within the EAR and is dependent on the ECCN and the country of destination for your item.
