This course provides HR, legal, and compliance professionals with a comprehensive understanding of how U.S. immigration law, export control regulations, and anti-discrimination rules intersect in the hiring and management of foreign national employees.

Participants will learn how to review immigration documents to support foreign employee license applications to the Bureau of Industry and Security (BIS) and Directorate of Defense Trade Controls (DDTC), including practical guidance on documentation, timelines, and eligibility. The course will also explore common visa scenarios that do not qualify for deemed export licenses, such as F-1 students without OPT or individuals employed by third-party sponsors.

In addition to export compliance, the course will focus on best practices for HR screening and recruiting processes, with a strong emphasis on:

• How to lawfully assess "U.S. person" status for roles subject to export controls;
• Drafting compliant job postings;
• Avoiding discriminatory hiring practices under the Immigration and Nationality Act (INA) and related federal regulations.

By the end of the course, participants will be equipped to support their organizations in building globally inclusive teams while staying compliant with U.S. legal requirements.
